Federal Court Mandates Freedom of Abrego Garcia from ICE Custody

A federal judge has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement lacks legal authority.

"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been re-detained, again without legal justification," the judge stated in her order.

The case originates in a mistaken deportation to El Salvador earlier this year, which the government later admitted was an mistake. Following his return to the United States to answer human smuggling charges, he was detained in federal detention.

In her decision, the court pointed out that the government lacks a current removal order, which prevents them from removing Mr. Abrego Garcia "for now."

The court proceedings center on conflicting claims. Whereas the former administration argues that Abrego Garcia is a affiliate of the MS-13 criminal organization, he categorically disputes this claim.
